On July 8, Florida Governor Ron DeSantis issued an Executive Order “to drive transparency in prescription costs for Floridians.” The Executive Order directs the states’ executive agencies to include provisions in all future contracts and solicitations with pharmacy benefit managers (PBMs) regarding the following:
- Prohibiting spread pricing;
- Prohibiting reimbursement clawbacks;
- Directing agencies to include data transparency and reporting requirements, including a review of all rebates, payments, and relationships between pharmacies, insurers, and manufacturers; and
- Directing all impacted agencies to amend all contracts to the extent feasible with these same provisions.
